Qui di seguito vengono condivisi i documenti che riguardano la Dichiarazione di Uso civico e collettivo dell’Ex Macello di via Cornaro a Padova. Oggetto: Bozza di “Dichiarazione di uso civico e collettivo” dell’Ex Macello e del suo parco, (Via Cornaro 1B, Padova) elaborata grazie alla capacità di auto regolazione della comunità di riferimento, per il riconoscimento dei diritti d’uso civico e collettivo del bene in oggetto.

In riferimento all’art. 7 del Regolamento dei Beni comuni del Comune di Padova – approvato con deliberazione di Consiglio Comunale n. 103 del 25.10.2021, in vigore dal 24 novembre 2021 – la comunità di riferimento dell’Ex Macello, comunità aperta ed eterogenea, formata da abitanti singolз e associatз, riunitз in assemblea, dopo essersi a lungo confrontatз e interrogatз sulle attività, le pratiche e le sperimentazioni laboratoriali realizzate nell’area dell’Ex Macello (Via Cornaro 1B, Padova), fra il 1975 e il 2021, propone la seguente bozza di Dichiarazione d’uso civico e collettivo – quale risultato della capacità autonormativa della comunità stessa – per il riconoscimento dell’Ex Macello, e segnatamente per la parte di parco e di strutture ed edifici, come Bene comune ad uso civico e collettivo, funzionale “al benessere della comunità e dei suoi membri, all’esercizio dei diritti fondamentali della persona e all’interesse delle generazioni future” (art. 2, Regolamento), nonché all’incontro delle persone per assemblee ed attività educative e culturali.

Preambolo alla dichiarazione di uso civico e collettivo

I beni comuni ad uso civico e collettivo richiedono che gli enti titolari del bene, pubblici e privati, riconoscano il diritto di uso civico collettivo e garantiscano l’inalienabilità, l’inusucapibilità e la sdemanialità anche al fine di preservarlo per le generazioni future. Per quanto riguarda i beni di proprietà pubblica, l’ente titolare è garante degli interessi collettivi che il bene esprime e favorisce l’esercizio dei diritti fondamentali da parte della collettività attraverso l’uso, la cura e la gestione dei beni comuni, secondo il principio di sussidiarietà orizzontale (art. 3.a, Regolamento). I beni comuni così intesi nascono dall’autorecupero di spazi sottoutilizzati, o percepiti tali, o che, in ogni caso, hanno dismesso la loro funzione sociale. Recuperare la funzione sociale di un bene, così come è stato fatto per l’ex Macello, risponde al bisogno di affrontare anche in forme collettive i modi di vivere il presente, di dare aspirazione alle esigenze di tantз di partecipazione diretta, autonoma, originale, recuperando spazio e tempo per la vita collettiva.

La comunità di riferimento intende formare una mappa articolata ed estesa in riferimento a processi tra diversi soggetti e alla trasformazione in chiave di vivibilità della città. Un bene comune è tale perché c’è una comunità aperta ed eterogenea che se ne prende cura ininterrottamente. Principio inderogabile della pratica dei beni comuni è il ripudio di ogni forma di razzismo, sessismo, fascismo e discriminazioni religiose.
Non si vogliono creare spazi omogenei, ma si vuole tener conto delle diversità per realizzare spazi collettivi ad uso non esclusivo, di sperimentazione per differenti relazioni sociali, politiche, economiche e culturali.

Questa bozza di dichiarazione esprime gli elementi basilari dell’uso civico e collettivo, che potranno essere ulteriormente sviluppati e articolati, nell’ottica della sperimentazione.
La pratica dei beni comuni nella forma degli usi civici e collettivi urbani rappresenta una forma dell’agire politico in relazione all’area metropolitana che non si limita alla gestione diretta degli spazi, ma si impegna costantemente ad affermare una dimensione collaborativa al fine di sperimentare altre forme di relazione sociale basate sulla cooperazione, il mutualismo, la solidarietà, la cura, l’autonomia e l’interdipendenza delle comunità, nonché l’ecologia sociale, politica e relazionale.

Usi

a) I beni comuni sono beni ad uso civico e collettivo non esclusivo e le eventuali economie generate sono non competitive. Le attività che si svolgono rifiutano una logica di mercificazione e non vogliono essere suppletive e/o sostitutive nell’erogazione dei servizi pubblici essenziali, ma si confrontano ed agiscono per la difesa e l’estensione dei diritti fondamentali per una vita degna ed un “buon vivere”; b) principio inderogabile nella programmazione delle attività è l’uso non esclusivo di ogni parte della struttura, in quanto la turnazione e la garanzia di utilizzo e accesso degli spazi da parte dei soggetti che ne fruiscono è il principio ispiratore dell’intero impianto dell’uso civico e collettivo.

Assemblea Pubblica

a) L’Assemblea pubblica: è il luogo e la modalità di elaborazione collettiva, aperta alla partecipazione di tuttз, nello spirito della Dichiarazione d’uso civico e collettivo come previsto dall’art. 2.i del Regolamento.
Nell’assemblea: si discute; si determinano le modalità decisionali, le attività e la loro cura; si accolgono le varie iniziative, tenendo conto delle proposte sia di singoli che di formazioni sociali o realtà collettive che vi partecipano; si coordinano gli usi dei beni comuni; si approva la formazione di tavoli tematici o altre sue articolazioni, in relazione alle diverse esigenze emergenti dal quotidiano svolgersi della vita della comunità e degli spazi dell’Ex Macello.

L’assemblea ha il compito di rendere trasparenti i processi e possibile l’autogoverno, a partire dalle esigenze, desideri e aspirazioni espresse.
b) Convocazione: le modalità di convocazione dell’Assemblea dovranno garantire la più ampia partecipazione, in congrui tempi e con adeguati mezzi di comunicazione, allo scopo di dare a tuttз l’opportunità di esprimere proposte e confrontarsi su possibili interventi.

L’assemblea si riunisce almeno una volta al mese, salvo diversa calendarizzazione approvata, se necessario, nella seduta precedente. Ogni assemblea si conclude con un resoconto e con il necessario aggiornamento del calendario delle attività del bene comune, che sarà reso pubblico. In caso di necessità potranno essere convocate assemblee straordinarie.

c) L’assemblea, nel rispetto della tensione all’informalità, può demandare a soggetti giuridici determinati, coinvolti all’interno del processo, lo svolgimento di funzioni operative. Tali soggetti agiscono subordinatamente a quanto deliberato in Assemblea e non hanno poteri decisionali autonomi inerenti le attività riguardanti la comunità.

In nessun caso su di essi ricadono oneri di organizzazione o responsabilità non ricompresi nelle funzioni strettamente assegnate.

Tavoli tematici, gruppi di lavoro e laboratori

Sottoinsiemi dell’assemblea (es. tavoli tematici, gruppi di lavoro e laboratori) sono parte dell’ecosistema organizzativo, decisionale e relazionale e si riuniscono pubblicamente, per definire e verificare gli aspetti pratici delle varie iniziative, incoraggiare e sviluppare riflessioni sulle pratiche, permettere l’incontro di conoscenze e saperi, organizzare specifiche attività interne e/o esterne agli spazi e mettere in relazione le varie attitudini soggettive.

Proposte

Le proposte dovranno essere discusse e approvate in Assemblea, in cui vengono accolte sulla base di criteri organizzativi e temporali e delle concrete possibilità di scambio mutualistico di tempi e capacità, nel rispetto dei principi fondanti dell’uso civico e collettivo e dei criteri di antifascismo, antirazzismo, antisessismo, antispecismo. Le attività non possono richiedere un contributo economico vincolante.

Formazione del consenso e modalità decisionali

La pratica degli usi civici e collettivi dei beni comuni si sviluppa in Assemblea per meglio coordinare la partecipazione continuativa alle pratiche di autogestione e determinare le modalità di gestione diretta, condivisa e partecipata delle attività e degli spazi, attuando i principi della cura e della democrazia in senso sostanziale. Le decisioni sono prese sulla base del consenso o di altre modalità di condivisione preventivamente stabilite che rispettino il dissenso. La partecipazione alle assemblee avviene con atteggiamenti non proprietari e non ostruzionistici, nel rispetto dei principi di inclusività e apertura previsti all’articolo 3.e del Regolamento, secondo il quale “le Dichiarazioni di uso civico e collettivo per la gestione dei beni comuni devono prevedere la possibilità che, in qualsiasi momento, altre/i cittadine/i interessati possano aderire e dare il proprio contributo e devono incentivare l’inclusione sociale e interculturale, le pari opportunità, la partecipazione delle/dei cittadine/i di minor età”.

Ripartizione delle responsabilità

La comunità di riferimento per l’uso civico e collettivo non può essere considerata responsabile delle opere di manutenzione straordinaria (salvo diversa decisione assembleare), degli oneri di prevenzione degli incendi e di messa in sicurezza che restano a carico degli enti titolari. Tali interventi dovranno essere indicati e concordati attraverso una deliberazione vincolante dell’Assemblea del bene comune, tenendo conto anche dei saperi e delle competenze della comunità di riferimento.

La responsabilità è sempre individuale a fronte di regole decise collettivamente di cui ci si impegna a dare la massima diffusione.
La redditività civica generata dalla comunità è un valore non strettamente monetario che compensa le utenze e gli oneri di manutenzione a carico dell’ente proprietario.

Risorse

In linea con l’articolo 12 del Regolamento sull’autofinanziamento, la comunità di riferimento può raccogliere sottoscrizioni o contributi per generare mezzi di produzione condivisi e favorire le attività quotidiane in chiave di riqualificazione e valorizzazione finalizzata all’accessibilità e alla fruizione collettiva del bene.

La comunità di riferimento promuove le autoproduzioni e la riconversione ecologica delle produzioni e dei consumi. Tali economie sono estranee ed alternative alle logiche di mercificazione e sfruttamento per un’esistenza libera e dignitosa, per realizzare qualità di vita ed equa redistribuzione delle risorse.

Per la realizzazione e lo svolgimento delle attività la comunità di riferimento può, previa decisione assembleare: ricorrere a forme di autofinanziamento quali la raccolta fondi e il crowdsourcing; stabilire accordi con altri enti per il finanziamento di specifiche iniziative o di determinate attività; reperire fondi pubblici e privati anche dotandosi degli strumenti giuridici necessari per accedere ai relativi bandi; accettare donazioni e patrocini finalizzati alle attività decise tassativamente in Assemblea.

L’assemblea può demandare a soggetti giuridici determinati, coinvolti all’interno del processo, lo svolgimento di funzioni operative. Tali soggetti agiscono subordinatamente a quanto deliberato dagli organi di autogoverno e non hanno poteri decisionali autonomi inerenti le attività riguardanti il bene comune. In nessun caso su di essi ricadono oneri di organizzazione o responsabilità non ricompresi nelle funzioni strettamente assegnate.

Diritto di Autonormazione civica

La pratica degli usi civici e collettivi e le forme di gestione diretta, condivisa e partecipata esprimono una costante capacità autoregolativa; pertanto, la presente dichiarazione d’uso, in virtù delle modalità sperimentali di uso e gestione degli stessi spazi, può essere modificata solo in Assemblea, convocata con forme adeguate di pubblicità al fine di favorire la più ampia partecipazione alle scelte della comunità. In ogni caso, il percorso di modifica della dichiarazione d’uso dovrà assicurare ampio confronto e adeguata condivisione.

È dovere del proponente dare immediata comunicazione scritta e motivata al Comune di ogni eventuale sospensione o evento che possa incidere sulle azioni sopra descritte.

Come parte integrante di questa bozza di Dichiarazione di uso civico e collettivo, si allega la “Memoria collettiva delle attività e degli usi all’Ex Macello, via Cornaro 1B, Padova, dal 1973 al 2021” al fine di motivare la richiesta di riconoscimento dei diritti d’uso civico e collettivo del Bene in oggetto e renderli effettivi mediante la presente “Dichiarazione d’uso civico e collettivo”.

FINE DICHIARAZIONE

Memoria collettiva delle attività e degli usi all’Ex Macello, via Cornaro 1B, Padova, dal 1973 al 2021

Sin dai primi anni ’70 lo spazio denominato “Ex Macello”, dal 1986 soggetto a vincolo paesaggistico secondo la L. 29/06/1939 n. 1497, è stato abitato, attraversato e vissuto da molte organizzazioni strutturate e da singoli cittadini e cittadine, che in questo spazio multifunzionale hanno potuto realizzare progetti di interesse culturale, politico, sociale e ambientale.

A titolo di mero elenco, nel voler testimoniare la vocazione aggregativa del luogo, si riportano le associazioni che negli anni hanno abitato le strutture dell’Ex Macello e che si sono occupate, istituendolo, del Parco Didattico (2013) e del Museo Laboratorio Didattico di Storia dell’Informatica “Amici dei Tesori del Mondo” FMACU-UNESCO (la cui ultima mostra è del novembre 2021).

Tale elenco si configura come una sorta di CV dell’Ex Macello che la comunità di riferimento, – composta oggi da una decina di organizzazioni – riunita in Assemblea, indica all’Amministrazione comunale quale attestazione e evidenza che l’Ex Macello è già “un bene comune gravato da uso civico e collettivo”.

L’Ex Macello è sempre stato uno spazio su cui l’Ente Locale Comunale ha rivolto la propria attenzione, pur, nei fatti, occupandosene sempre grazie (e a seguito) delle sollecitazioni che gruppi organizzati e non di cittadini hanno espresso, ora per la salvaguardia delle sue strutture di interesse archeologico e storico; ora per la tutela del Bosco, il quale si configurava come un’area peculiare, dal punto di vista ambientale, data la sua composizione per flora e fauna. Le organizzazioni che negli anni hanno vissuto questo spazio hanno avuto relazioni contigue, a volte molto collaborative, altre meno, ma comunque contrassegnate dalla possibilità di organizzare attività e iniziative che si sono sempre caratterizzate per la fruibilità, accessibilità e spesso gratuità.

Tutte queste organizzazioni, ma ancora più spesso singoli cittadini che per il luogo si sono adoperati, hanno avviato, nutrito e stimolato fin dall’inizio e per tutto il periodo di permanenza nell’area dell’ex Macello, percorsi partecipativi aperti alla cittadinanza, a chiunque manifestasse interesse per il luogo, la sua tutela e la realizzazione di attività in esso. Si può dire che questa disposizione è stata un filo conduttore, una delle linee guida che hanno caratterizzato chiunque abbia frequentato l’Ex Macello, fin dal primo concorso di idee che la giunta comunale promosse nel 1977 “per il recupero e la ristrutturazione dell’area ex Macello affinché venga destinata ad attività culturali e per l’esercizio delle funzioni svolte dalle varie associazioni culturali democratiche operanti nelle città, prevedendo la salvaguardia delle alberature esistenti” e senza soluzione di continuità fino alle più recenti iniziative.

Gentile Fiorita Luciano

La ringraziamo per la cortese risposta, le informazioni condivise e l’auspicio di proficua collaborazione che raccogliamo volentieri.

Ci preme, però, mettere in evidenza che dalla vostra risposta non si evince un riconoscimento dell’attività civica da noi già svolta e documentata nell’area dell’Ex Macello. Teniamo, inoltre, a ribadire che la Dichiarazione di uso civico e collettivo, presentata al Comune in data 23 dicembre 2021, in base all’articolo 7 al comma 4 del Regolamento sui Beni Comuni, vada considerata ai fini della sua approvazione, tramite determinazione dirigenziale del/della Capo Settore dell’Unità organizzativa responsabile del processo e della/del Capo Settore interessata/o dalla definizione della stessa. Al comma 3 dell’articolo 7, inoltre, è indicato che, come nel caso in oggetto, qualora comporti una modifica nell’individuazione del bene comune, prima di essere approvata ai sensi del comma 4 debba essere recepita dalla Giunta Comunale.

Siamo consapevoli che si tratta di un processo di riconoscimento complesso e che non può essere risolto con automatismi amministrativi: pertanto ci rendiamo disponibili (non a caso abbiamo definito “bozza” la nostra Dichiarazione) ad avviare un processo di confronto che auspichiamo il Comune voglia definire nelle modalità e nei tempi.

Ha richiamato la nostra attenzione il fatto che la proposta avanzata nella riposta del Comune riguardi una parte residuale dell’area in oggetto e faccia riferimento ad un progetto già realizzato e candidato a ricevere un finanziamento nazionale. La qual cosa, visto che riguarda un’area già percepita come bene comune, caratterizzata da un uso civico, punto di riferimento per tantз cittadinз, e su cui già si erano realizzati processi di consultazione e proposta documentati e resi noti, avrebbe dovuto richiedere almeno un confronto pubblico. Ricordiamo che sulla stessa area abbiamo facilitato processi di consultazione e proposte pubbliche che abbiamo reso note e messo a disposizione del Comune.

Per questi motivi auspichiamo che l’approvazione della Dichiarazione di uso civico e collettivo e il riconoscimento dell’area come bene comune possa essere l’occasione per una riflessione ed una discussione aperta e democratica sul futuro dell’area.

Di seguito potete leggere un percorso, non esaustivo, delle iniziative più rilevanti realizzate nell’Ex Macello, anche attraverso iniziative di crowfunding che hanno consentito, ad esempio, la realizzazione dell’ultima (novembre 2021) mostra di apparecchiature informatiche[1]:

2021:

Novembre: Mostra per il museo didattico di Storia dell’Informatica, visitata da un migliaio di persone, ha ottenuto un finanziamento da parte di Wikimedia, che ne ha riconosciuto il significativo valore scientifico e educativo.

Lancio della rete Beni Comuni Padova formata da un gruppo eterogeneo di associazioni, formali e informali, e da singoli cittadini interessati ad una tematica emergente a livello nazionale.

Sostegno alla campagna contro l’edificazione dell’area attualmente destinata alla “Nuova Pediatria” di Padova

2020:

Prosecuzione dello studio e partecipazione a reti ed iniziative riguardo l’amministrazione condivisa Beni Comuni e Usi Civici e acquisizione (tramite la Rete nazionale dei beni comuni emergenti) dei principi per la scrittura condivisa di un Regolamento cittadino per Padova.

Le Associazioni della CLAC iniziano la collaborazione con la manifestazione Sperimentando.

Viene pubblicato “Esplorare per conoscere”, guida metodologica per le scuole su quindici Sentieri Natura, frutto di 20 anni di sperimentazioni dove la CLAC ha collaborato con ARPAV, Italia Nostra, CAI, WWF.

2001:
Inizia il progetto ReFun per il recupero degli Elaboratori elettronici

Proseguono le attività del gruppo di Narrazione Orale con riunioni regolari e seminari e la collaborazione con il gruppo Giocoleria Medioevale e Teatro di Strada.

Continuano i lavori di manutenzione della palazzina, in particolare del tetto.

Si completa con una terza sala l’esposizione delle macchine del Museo Didattico di Storia dell’Informatica.

Le biblioteche si arricchiscono e contano più di 20000 volumi tra biblioteca di informatica (almeno 4000 volumi di cui 1700 già catalogati), internazionale per ragazzi, ambiente e cultura veneta, economia, americana.

2000:

La rivista Confluences di FMACU-UNESCO pubblica un articolo sul Museo Didattico di Storia dell’Informatica.

Partecipazione come responsabili della Segreteria Internazionale degli Amici dei Tesori del Mondo dell’UNESCO (ATM-FWT) il 26/05 a Konradsburg dell’Associazione Forderkreis nell’ambito degli scambi culturali continuativi dell’ultimo decennio.

Un borsista tedesco laureando in Fisica in Erasmus, ha rimesso in funzione alcune apparecchiature del nostro Museo ferme da decenni e ha presentato una dettagliata descrizione di questa sua interessante esperienza nel sito web dell’Università di Göttingen.

Il Museo Didattico di Storia dell’Informatica giunge ad inventariare 2000 pezzi ed il Comune di Padova ne è diventato donatore, insieme all’azienda ospedaliera, a scuole, ad imprese e privati. Una borsista greca ha contribuito a inventariare e sistemare a scaffale 500 macchine.

Nel corso dell’estate, in collaborazione con il gruppo Pluto del Dip. di Elettronica Unipd e l’Istituto Professionale di Stato “E. Cornaro” di Jesolo, sono stati organizzati i corsi intensivi per Operatori di server di rete in ambiente Linux.

Studi per concretizzare il progetto di Laboratorio di Didattica degli Ecosistemi Acquatici anche con rilievi fotografici in collaborazione con il Club Sommozzatori Padova.

La Sezione di Padova degli Scout CNGEI (Corpo Nazionale Giovani Esploratori Italiani) comincia ad usare per i più giovani un’aula nel Parco Didattico: gli educatori del Parco collaborano per attività a carattere ambientale.

Festeggiamento del Ventennale del Gruppo di Danza Popolare “La Tresca”.

Si consolida l’attività del gruppo Giocoleria Medioevale e Teatro di Strada.

Collaborazione con l’Ufficio Stranieri Unipd e con studenti del Progetto Leonardo da Spagna e Grecia.

Lavori di manutenzione dei fabbricati: tetto della Palazzina e altri due edifici, oltre che del Parco e Orto biologico.

17/02: Inaugurazione ufficiale di una prima parte del Museo Didattico di Storia dell’Informatica. 1999:

E’ stato avviato il Corso di informatica per la Terza Età in collaborazione con Enaip e gli stagisti Progetto Leonardo.

Il Museo Didattico di Storia dell’Informatica conta 2500 pezzi Si sviluppa la raccolta di strumenti scientifici.

Proseguono i campi di lavoro del Servizio Civile Internazionale e la collaborazione con gli stagisti Progetto Leonardo.

Numerose scuole partecipano ai laboratori offerti dal Parco Didattico e alle lezioni pratiche al Mulino a pietra.

1998:

Sono molto frequentati i laboratori di affresco e marmorino, disegno, pittura su vetro e modellazione della creta del gruppo Arte e Vita.

Proseguono e sono ben frequentati (anche grazie all’accordo con ARCS-Unipd) i corsi di lingua albanese, araba, francese, inglese, portoghese, serbo-croato.

Si consolida l’ospitalità del Convegno dei giovani esperantisti che avverrà anche negli anni a seguire. 1997:

Proseguono la raccolta delle apparecchiature informatiche e i lavori di catalogazione delle macchine per il Museo Didattico di Storia dell’Informatica.

Visite scolastiche allo Stagno, all’Orto biologico, al Parco Didattico, al Mulino con produzione del pane, (proseguiranno anche negli anni successivi).

Continuano le attività dell’Ufficio Tutela Animali, con visite quotidiane, specialmente riguardo ai felini.

Corsi per insegnanti di Geologia, Astronomia, Erbe officinali, Orto biologico, lingue, etc. (proseguiranno anche negli anni successivi).

Continuano le attività del Gruppo Speleo con incontri infrasettimanali, attività speleologiche urbane in collaborazione con Università e Soprintendenza, la redazione del Catasto Regionale delle Grotte, attività didattiche nelle scuole.
