Sulla vicenda di Sala Pinelli, dopo mesi di attesa, il Comune ha battuto un colpo anche grazie al polverone scatenato dai numerosi articoli di stampa a seguito di questo comunicato
“L’amministrazione non sa come applicare il Regolamento Beni Comuni”. Lo avevamo detto e oggi abbiamo la “confessione” da parte dell’assessora Benciolini.
Ma la risposta non è certamente quella sperata dalla comunità di riferimento.
L’assessora infatti ha chiarito che il Comune non è pronto per la Dichiarazione di uso civico, proponendo un ben meno impegnativo patto di collaborazione. Che però non è la forma utile, né richiesta, dall’assemblea della sala.
Quindi nessun riconoscimento della comunità della sala, che doveva essere il pilastro “rivoluzionario” del Regolamento patavino, anzi. Perché nel frattempo la comunità di sala Pinelli è stata sbattuta fuori e il Comune ha provveduto a cambiare le chiavi, trattennendo all’interno tutti i materiali, e interrompendo tutte le attività.
La sala, insomma, è tornata chiusa.
Pubblichiamo un commento a caldo da parte di uno degli attivisti di via Pinelli. Che nel frattempo, in polemica, ha abbandonato il progetto:
Ho deciso di prendermi del tempo per provare a riordinare le idee ma, leggendo quest’articolo, non posso non provare a rispondere a caldo su alcune questioni poste dall’assessora.
(NB: Non faccio più parte di Officina quindi questo sfogo è a titolo meramente personale)
1) 𝐀𝐛𝐛𝐢𝐚𝐦𝐨 𝐟𝐚𝐭𝐭𝐨 𝐜𝐨𝐩𝐢𝐚/𝐢𝐧𝐜𝐨𝐥𝐥𝐚 𝐝𝐞𝐥𝐥𝐚 𝐃𝐢𝐜𝐡𝐢𝐚𝐫𝐚𝐳𝐢𝐨𝐧𝐞 𝐝𝐢 𝐮𝐬𝐨 𝐜𝐢𝐯𝐢𝐜𝐨.
Sì, siamo colpevoli. Però a ben vedere quest’accusa l’assessora dovrebbe rivolgerla verso sé stessa. Perché il Comune che lei amministra si è tanto vantato di essere il primo in Italia ad aver inserito all’interno del Regolamento beni comuni la figura dell’Uso civico. E oggi ci dice che non sanno come attuare quel regolamento.Se l’assessora si fosse messa nei nostri panni si sarebbe agevolmente accorta che non essendoci in Italia dichiarazioni di uso civico poste in essere poteva essere una buona idea stilare un vademecum, una traccia, un “template” su cui basarsi. Il Comune non sa come si faccia a dichiarare un uso civico e si aspetta che i cittadini sappiano scriverne uno? Cos’altro potevamo fare se non trarre spunto dall’unica bozza in questo momento presentata, quella dell’ex Macello di Padova (che, ricordiamolo, aspetta ancora risposta).
2) 𝐒𝐢𝐚𝐦𝐨 𝐮𝐧 𝐦𝐚𝐠𝐚𝐳𝐳𝐢𝐧𝐨. Forse all’assessora sfugge un particolare: l’idea di sala Pinelli, che noi trovammo letteralmente come magazzino di frutta e verdura durante la pandemia, nasce proprio dalla necessità di far fronte alle centinaia di richieste settimanali di computer durante il lockdown, quando giravamo per la città a recuperare i dispositivi informatici. Il risultato? Le nostre case, non certo regge, invase da computer e noi costretti a pranzare in divano perché nel frattempo il tavolo era invaso da case e monitor. Ci scusi il Comune quindi se il nostro progetto non è fatto di idee ma di ferraglia, monitor e tastiere.
E non ci venga detto che non abbiamo fatto tutto il possibile per provare a limitare il problema. Perché se non fosse stato per noi quella sala sarebbe ancora completamente vuota e priva di mobilio: le nostre braccia hanno provato a dare un ordine portando i mobili che oggi si trovano all’interno della sala chiusa a chiave. E avremmo pure fatto di meglio se una solerte funzionaria non ci avesse intimato di non portare altro mobilio, per provare a riorganizzare gli spazi. La stessa funzionaria che, nel momento in cui ci veniva consegnata la sala come Officina, si premurò di avvertirci che “comunque qui non potete tenere i computer”. È la burocrazia, baby.
E ancora: sarebbe stato molto più semplice se il Comune avesse accettato di mediare con AcegasApsAmga nel tentativo di poter conferire i dispositivi non recuperabili presso i centri di raccolta. Ma evidentemente sordi all’idea che la “spazzatura informatica” abbia un valore e che il progetto anzi potesse fungere da filtro per fare in modo che questi materiali fossero correttamente smaltiti siamo stati costretti a conferire da normali cittadini quei materiali presso i centri. Tre alla volta, in un anno. Poco importa che fossero monitor o mouse, sempre tre pezzi.
Inevitabilmente se fai un lavoro di riuso e recupero ti vengono donati materiali che possono non funzionare. E se recuperi computer inevitabilmente ogni 100 computer raccolti una percentuale importante – e ingombrante – non sarà recuperabile. Siamo bravi ma per i miracoli ci stavamo attrezzando.
Ma ben consci del problema ci eravamo pure attivati per chiedere al Comune un magazzino in cui tenere tutto ciò che non poteva essere riciclato e, quando sembravano aver individuato un garage (non proprio vicinissimo alla sala), gli stessi addetti scoprono che quel posto è già assegnato come sede a un’altra associazione!
3) 𝐒𝐢𝐚𝐦𝐨 𝐚𝐛𝐮𝐬𝐢𝐯𝐢? Lo si chieda alle persone che ci gravitavano intorno, agli abitanti del quartiere, al coro e al gruppo teatrale che avevano finalmente un posto in cui provare, alle persone che hanno ricevuto in donazione un computer che altrimenti non avrebbero potuto permettersi. A chi lì dentro ci ha lavorato gratuitamente in coworking, agli anziani a cui veniva data assistenza informatica. Alle decine di persone che hanno attraversato quella sala, si sono scambiate esperienze, hanno prodotto video e foto, si sono riunite.
Non abbiamo mai chiesto contributi economici o favori.
Abbiamo aperto una sala chiusa e l’abbiamo resa davvero di tutte e tutti. Come dovrebbe essere per una sala pubblica che sognava, da grande, di diventare comune.Perché se abusivismo significa vita, significa socialità, burocrazia evidentemente significa silenzio e morte. Come una sala che era chiusa ed è tornata ad essere chiusa. La legalità ha vinto, sia messo agli atti. Viva allora l’abusivismo.

A integrazione ricondividiamo pure un breve testo di Nicola Capone (libero ricercatore, docente e attivista) a commento della vicenda:
Sia nel Regolamento sia nelle FAQ ad esso allegate i passaggi per avviare il percorso di riconoscimento del “Diritto d’uso civico e collettivo” di uno spazio riconosciuto “bene comune”, ovvero funzionale all’esercizio dei diritti fondamentali, sono molto chiari e lineari. Il problema non è tecnico, è politico. E questo non è una novità, perché non c’è tecnica, a mio parere, che non sia politica e per inverso non c’è politica che non abbia anche aspetti tecnici. Il punto è che il “Diritto d’uso civico e collettivo” pone questioni sia tecniche che politiche, ad altissima intensità perché mette in discussione gli assetti proprietari del bene, che – nonostante la dottrina giuridica, le sentenze della Corte suprema e una consolidata prassi amministrativa – sono ancora rigidamente incardinati in una dogmatica struttura privatistica da ancien régime.
Finanche la proprietà pubblica è intrappolata dalla tecnica giuridica e politica di un diritto privato vecchio stampo che orienta amministratori e tecnici a ritenere il bene pubblico di “appartenenza” all’ente pubblico territoriale, riducendo il Comune al “solo” ruolo di “proprietario” dei beni a lui nominalmente attribuiti.
Questo clamoroso “equivoco” non tiene conto del fatto che lo schema proprietario applicato ai beni pubblici ha la funzione di garantire, da parte dell’ente, l’appartenenza collettiva del bene e gli interessi generali ad esso collegati. Per questo motivo si usa la “fictio” del titolo di proprietà: il bene è in proprietà dell’ente di riferimento perché questo si faccia garante dell’appartenenza collettiva del bene stesso. In questo senso si dice che il Comune, ad esempio, è un’ente esponenziale della comunità. Come da questo approccio si sia passati all’esproprio dei beni di appartenenza collettiva da parte degli enti pubblici sotto l’emblema di Beni pubblici è uno dei grandi inganni perpetrati a danno della democrazia costituzionale. Tornando a noi, questa postura impedisce alla parte tecnica-dirigenziale di operare. Per quanto riguarda la parte politica c’è il grande tabù della “libera e autonoma” iniziativa dei singoli e degli associati, relativamente al tema dell’uso, della gestione e del governo dei beni pubblici. Il tema potrebbe essere posto in questi termini: come garantire l’autonomia delle comunità di riferimento di un bene comune ad uso civico e collettivo, evitando che questa autonomia si traduca in un uso esclusivo e privatistico del bene da parte di un gruppo ristretto? Come evitare che il ruolo di garante svolto dall’ente pubblico, per tutelare l’appartenenza collettiva del bene comune e il diritto d’uso civico e collettivo, si tramuti in una forma di inibizione dell’autonoma iniziativa degli/delle abitanti, che invece dovrebbe essere costituzionalmente “favorita”? Una via, pure prevista dal Regolamento dei beni comuni di Padova, è la co-progettazione o, in ogni caso, la possibilità di avviare un processo di partecipazione pubblica volto a istituire/riconoscere, sperimentare e validare il “diritto d’uso civico e collettivo”.
Al limite, in via transitoria, si potrebbe concordare un “patto di collaborazione complesso” – che io chiamerei “Patto di comunità” – che ha come oggetto proprio l’istituzione di una prassi d’uso civico e collettivo o il consolidamento di una prassi già esistente. Sarebbe un’occasione di “conflitto” altamente istruttivo, una forma animatissima di apprendimento istituzionale. Questo permetterebbe di sperimentare una forma di accesso alla città che non è scontata e richiede tanto coraggio da parte di tutti i soggetti coinvolti. Mi scuso se sono stato schematico e troppo sintetico ma spero ci siano altre occasioni di approfondimento.
