Da oltre 10 mesi l’assemblea di gestione della sala di via Pinelli ha presentato la richiesta di riconoscimento dell’Uso Civico e collettivo secondo le modalità previste dal Regolamento dei Beni Comuni approvato dall’amministrazione il 24/11/2021.

Il sindaco Giordani e la sua giunta hanno spesso presentato il Regolamento dei Beni Comuni come uno strumento di partecipazione diretta dei cittadini alla gestione dei beni. Uno strumento però che attualmente è fermo al palo. 

Risultano appena 3 i patti stipulati finora aventi ad oggetto o beni immateriali oppure piccoli interventi di verde pubblico cimiteriale: un risultato deludente per un Regolamento sbandierato come “il più avanzato d’Italia”. 

La comunità di riferimento di Sala Pinelli, che gestisce le attività ormai da oltre due anni, avrebbe potuto rappresentare un cambio di rotta. Ricordiamo infatti che la possibile assegnazione della Sala è stato il frutto di una decisione unilaterale del Comune di inserirla tra i beni assegnabili. 

Poteva apparire scontato che, in presenza di una comunità di riferimento attiva, riconoscibile e organizzata in assemblea e in presenza della Sala tra i beni assegnabili, il procedimento amministrativo avrebbe dovuto essere una mera formalità. 

Invece nonostante le attività all’interno della sala abbiano dovuto subire una brusca sospensione in attesa della decisione del Comune ci troviamo a ribadire l’urgenza del riconoscimento della nostra esperienza come esperienza di comunità, aperta alla cittadinanza e che riqualifichi e renda nuovamente fruibile un Bene Comune rimasto chiuso per troppo tempo.

È il momento che il Comune decida se lo strumento di democrazia partecipativa di cui si è dotato è solo un oggetto di propaganda oppure possa servire a valorizzare esperienze culturali e sociali, tenuto conto della cronica mancanza di spazi comuni di cui soffre questa città.

Per questo motivo abbiamo indirizzato al Sindaco questa lettera aperta:

All’attenzione del Sindaco del Comune di Padova

Gentile Sindaco,

dopo mesi di attese ci troviamo costrett* a scrivere questa lettera aperta per provare a fare il punto sul riconoscimento dell’esperienza di Sala Pinelli come Uso Civico da parte del Comune. 

Per completezza occorrerà ricordare brevemente i passaggi che hanno caratterizzato la storia di questa sala.

La sala comunale di via Pinelli è una struttura di proprietà comunale sita in rione Crocifisso, rimasta inutilizzata per molto tempo. Durante il lockdown, sotto l’egida del CSV, la sala è stata riaperta e adoperata per le operazioni di volontariato del Centro Servizi Volontariato. 

Esaurito il picco dell’emergenza pandemica il CSV, con encomiabile sguardo al futuro e capacità di lettura dei processi sociali, ha fatto da tramite affinché molti dei servizi e delle attività che si svolgevano all’interno della sala potessero continuare ad esistere, stipulando una convenzione con il Comune per permettere la continuità delle attività svolte. 

Dall’esperienza in collaborazione con il CSV nasce, in nuce, la prima comunità di riferimento della sala. Le attività per il quartiere e la cittadinanza ottengono il riconoscimento del Centro Servizi Volontariato e, di riflesso, da parte del Comune che concede la sala e, addirittura, ne proroga l’utilizzo oltre la scadenza naturale. 


All’interno della sala si svolgono attività rivolte ai bambini, agli abitanti del quartiere e ai cittadini tutt*.

La comunità di riferimento comincia a dotarsi degli strumenti decisionali necessari al corretto funzionamento della sala e nasce l’assemblea di sala Pinelli, una struttura orizzontale formata dalle realtà che hanno dato vita all’esperienza della sala e da altre realtà che vi collaborano in modo stabile e continuativo. 

Con deliberazione del Consiglio Comunale n. 103 del 25/10/2021 il Comune di Padova si dota del c.d. Regolamento Beni Comuni, uno strumento di democrazia partecipata che, nelle intenzioni dei promotori, intende radicalmente modificare i rapporti tra i cittadini e i “beni comuni” individuati o da individuare. 

Si tratta di un provvedimento orgogliosamente sbandierato dagli amministratori contenente, come novità assoluta rispetto ai tanti comuni che si sono già dotati di strumenti simili, la possibilità di riconoscimento da parte di questo ente dei c.d. usi civici da parte delle comunità di riferimento. 


Il regolamento raccoglie subito l’interesse dell’assemblea di via Pinelli e viene ritenuto lo strumento più adeguato per la valorizzazione della nostra esperienza che avrebbe tutte le carte in regola per il riconoscimento dell’uso civico e collettivo.

Con enorme sorpresa, senza che da parte della comunità di riferimento della sala vi fossero pressioni o interlocuzioni con l’amministrazione, la sala è stata inserita all’interno della prima mappatura dei beni comuni assegnabili in data 22.02.2021. 


Il tutto senza che il Comune si premurasse di informare la comunità di riferimento. 

Considerando le attività svolte fin lì dalle associazioni, dai singoli e dai gruppi informali costituitisi in assemblea era opinione condivisa che il riconoscimento dell’uso civico e collettivo della sala fosse solo una formalità i cui tempi fossero semplicemente dettati dalle nuove formalità giuridiche da applicare al regolamento appena approvato. 

Non vi era dubbio tra le realtà che proponevano il riconoscimento che, esistendo la comunità di riferimento e la prova delle attività fino a quel momento svolte, la procedura sarebbe stata rapida e immediatamente operativa. 


Forte di questa convinzione tutte le componenti di via Pinelli riunite in assemblea in data 14/04/2022 si premurano di inviare la documentazione necessaria per l’avvio dell’iter. 

Alla base della proposta, approvata all’unanimità dall’assemblea, vi era la possibilità di autogestire in autonomia la sala ma aprendo a qualunque realtà volesse innestarsi nel percorso già intrapreso. Questa considerazione era fondante rispetto alla richiesta, motivata dalle molte attività che in sala si svolgevano o che si programmava di svolgere. 

Invece il procedimento si è immediatamente arenato e il Comune ha interrotto ogni comunicazione con le realtà proponenti. 

A parte due contatti telefonici con gli addetti del Gabinetto del Sindaco ad oggi non si hanno più notizie del procedimento. 

Questa inerzia da parte del Comune ha determinato la sostanziale sospensione delle attività previste e/o programmate all’interno della sala.

Se l’inattività del Comune poteva essere giustificabile, in un primo momento e per cause totalmente imputabili all’ente, dalla mancata formazione del personale e la mancanza di figure di coordinamento del procedimento ci risulta però che mesi addietro le attività di formazione delle figure preposte sia stata effettuata da Labsus e che sia stato preparato il vademecum necessario per determinare i ruoli degli enti coinvolti. 

Questo silenzio, lungo più di 6 mesi, ad oggi ci risulta incomprensibile. Il regolamento dei Beni Comuni non doveva essere il fiore all’occhiello della democrazia partecipativa? La sostanziale continuità amministrativa con la precedente giunta, guidata dallo stesso sindaco Giordani, aveva fatto immaginare un iter meno tortuoso affinché il Regolamento fosse posto pienamente in essere.

Lo stesso Giordani, partecipando all’evento  “L’immaginazione civica – il Regolamento dei Beni Comuni a Padova; non una cosa qualsiasi” organizzata da Coalizione Civica per Padova, usava parole inequivocabili circa l’interesse per l’amministrazione implementare i patti di collaborazione e gli usi civici, garantendo il proprio sostegno.

Ad oggi però, da quanto risulta dai canali ufficiali, sono solo tre le esperienze riconosciute di Beni Comuni nella città di Padova.

Senza voler sminuire l’importanza delle singole esperienze ci chiediamo se davvero la sottoscrizione di tre patti di collaborazione – due riferibili a fioriere e aiuole cimiteriali e una riguardante una generica opera di pulizia e lotta al degrado – in sei mesi rappresentano per l’attuale giunta la piena applicazione di un regolamento che è stato definito “rivoluzionario”. 

Speravamo che l’esperienza di Sala Pinelli contribuisse a dare lustro al Regolamento andando a invertire il paradigma della partecipazione condivisa tra Amministrazione Comunale e Cittadinanza Attiva. 

L’ultima comunicazione ufficiale del Comune invece ci riporta con i piedi per terra, costringendoci ad affermare che nulla è cambiato nel rapporto tra Pubblica Amministrazione e Cittadinanza. 

Nell’ultima mail, in data 10/08/2022 i proponenti venivano informati che “la proposta di collaborazione relativa a Sala Pinelli è stata presa in carico dal Settore competente, Servizi Demografici e Cimiteriali, Decentramento”.

Inoltre la mail specifica che è stata avviata la procedura per un Patto di Collaborazione che prevede il coinvolgimento del Tavolo di Comunità dei Servizi Sociali.


Da un punto di vista meramente amministrativo facciamo notare che il patto di collaborazione non era in nessun modo previsto dalla richiesta di questa assemblea. Né nella richiesta di riconoscimento dell’uso civico né nelle comunicazioni successivamente intercorse tra i proponenti e l’amministrazione. Se questa Amministrazione intende rispettare quanto approvato dal Consiglio Comunale riteniamo debba esprimersi sulle richieste dell’assemblea di via Pinelli – cioè il riconoscimento dell’uso civico – e non formulare proposte nuove che sono state esplicitamente escluse dalla comunità di riferimento per motivi organizzativi. 

Nella mail in oggetto inoltre si fa riferimento al “previsto coinvolgimento del  Tavolo di Comunità dei Servizi Sociali”, soggetto che formalmente non fa parte dell’assemblea. Nel premettere che le realtà di Sala Pinelli hanno, nel corso del tempo, collaborato attivamente con il suddetto tavolo per la creazione di eventi specifici appare necessario ricordare che la natura della nostra assemblea è aperta e plurale.

Nulla osta, nel caso il Tavolo di Comunità dei Servizi Sociali esprimesse tale desiderio, all’integrazione dello stesso all’interno della nostra assemblea. Altra cosa invece ci appare il voler snaturare la natura della richiesta – ma sopratutto dell strumento dell’uso civico – alle necessità dell’amministrazione che nulla hanno a che vedere con il Regolamento. 

Con la presente mail intendiamo dunque ribadire le nostre richieste, così come formulate nella proposta inoltrata secondo i criteri individuati da questa amministrazione e stimolare una reazione da parte della macchina amministrativa, evidentemente inceppatasi. 

Riteniamo inoltre che si debba agire con celerità poiché i ritardi amministrativi hanno ripercussioni importanti nelle attività della sala – lo ripetiamo, sostanzialmente congelate – e nella tenuta della comunità di riferimento che, privata del luogo fisico naturale di azione, rischia di veder crollare l’interesse per lo svolgimento delle attività e l’entusiasmo verso l’esperienza collettiva della gestione di un Bene Comune. 

Che non sarebbe una buona notizia per la città e per il quartiere. E sicuramente non è quell’inversione di tendenza che il Regolamento Beni Comuni avrebbe dovuto apportare nel rapporto tra cittadini e istituzioni.
